Terms of Use

1. Scope
These terms govern the use of the tool "Ads Studio by Marius Blau" including its MCP interface (together, the "Tool"), provided by Marius Blau (the "Provider"). The Tool is offered exclusively to businesses (entrepreneurs within the meaning of Section 14 of the German Civil Code, B2B). Use by consumers is excluded.
2. Service
The Tool enables the analysis and management of Google Ads accounts via the Google Ads API, partly supported by AI-generated analyses and suggestions. The Tool is under continuous development and is provided "as is", without warranty of specific characteristics. There is no entitlement to availability, freedom from errors, or any particular advertising outcome.
3. Access
Access is personal and granted via an allowlist maintained by the Provider, combined with sign-in through the user's own Google account. The Provider may suspend access at any time without stating reasons, in particular in the event of violations of these terms or of Google's policies. Access credentials and API keys must be kept confidential and must not be shared with third parties.
4. User Obligations
- The user accesses only Google Ads accounts they are authorized for (their own accounts or accounts to which the owner has granted them access).
- The user is solely responsible for the lawfulness of their campaign content, in particular compliance with Google Ads policies and applicable competition, trademark, and professional regulations (e.g. healthcare advertising).
- Violations by the user that are attributed to the Provider vis-à-vis Google (e.g. burdening the Provider's API access) entitle the Provider to immediate suspension; the user indemnifies the Provider against third-party claims to the extent the user is responsible for the violation.
5. Changes Only After Confirmation
Write operations (e.g. budgets, bids, campaigns, keywords) are first presented by the Tool as a proposal with an overview and are executed only after the user's explicit confirmation. By confirming, the user assumes responsibility for the change. AI-generated suggestions are non-binding recommendations; reviewing them is the user's responsibility. Executed changes are logged (see Privacy Policy).
6. Liability
The Provider is liable without limitation for intent and gross negligence, as well as for injury to life, body, or health. In cases of slight negligence, the Provider is liable only for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for this type of contract. In cases of slight negligence, liability for lost profits, unrealized advertising success, data loss on the user's side, and indirect damages is excluded. Liability under the German Product Liability Act remains unaffected.
7. Term and Termination
This agreement runs for an indefinite period. Either party may end the use at any time — the Provider by suspending access, the user by notice or by revoking the Google authorization. Upon termination, the user's access keys are revoked.
8. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is — where permissible — the Provider's registered seat. Should individual provisions be invalid, the remainder of this agreement remains in effect.
